Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the services provided by Ascend Tech Solutions (“we,” “us,” or “our”). By accessing or using our services — including our APIs, platform, and website — you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using any part of the Ascend Tech Solutions platform — including but not limited to submitting a transaction, using our API services, registering as a merchant, or browsing our website — you agree to comply with and be legally bound by these Terms.

If you do not agree to these Terms, you may not use our services.

2. Definitions

Platform: The digital infrastructure and APIs operated by Ascend Tech Solutions for providing payment gateway services.

User: Any individual or entity using the Ascend Tech Solutions platform, including customers and merchants.

Merchant: A business or individual that has registered with Ascend Tech Solutions to use our API and platform services.

Customer: End users who interact with a merchant and whose transactions pass through Ascend Tech Solutions.

Services: All services provided by Ascend Tech Solutions, including but not limited to API access, payment processing, and merchant dashboard.

3. User Responsibilities

Users must provide accurate and complete information during registration and use.

Users must not use Ascend Tech Solutions services for any unlawful, fraudulent, or abusive purposes.

Merchants must adhere to all applicable laws, payment regulations, and service guidelines when using the platform.

4. Platform Responsibilities

Ascend Tech Solutions shall make reasonable efforts to maintain uptime, reliability, and security of the platform.

The company will facilitate transaction routing, payment status updates, and refund mechanisms according to posted policies.

5. Limitation of Liability

To the fullest extent permitted by law, Ascend Tech Solutions is not liable for:

• Merchant delivery failures or service disputes;
• Failures of third-party systems (e.g., banks, wallets, processors);
• Indirect, incidental, punitive, or consequential damages.
• Liability is limited to the transaction amount in question or PKR 10,000 — whichever is lower.

6. Termination of Access

We reserve the right to suspend or terminate access to our services at any time, with or without notice, for any reason — including violation of these Terms or misuse of the platform.

7. Force Majeure

Ascend Tech Solutions shall not be held responsible for any failure or delay in service caused by factors beyond our control, including but not limited to:

• Acts of God or natural disasters
• Internet or network outages
• Cyberattacks or security incidents
• Governmental restrictions, strikes, or power failures

8. Cookies & Tracking Policy

Ascend Tech Solutions may use cookies, web beacons, and other tracking technologies to enhance user experience and analyze performance.

By using our platform, you consent to the use of cookies as described below:

Essential Cookies: Required for core platform functionality and security.

Performance Cookies: Help us analyze platform usage and optimize system performance.

Analytics Tools: We may use tools such as Google Analytics or Meta Pixel to track engagement and improve services.

Users may choose to disable cookies in their browser settings; however, doing so may affect platform functionality.

9. API Usage Policy

This section applies to all merchants and developers using Ascend Tech Solutions API services.

Permitted Use:

APIs may only be used for legitimate, approved business operations as defined in your onboarding documents.

Fair Usage:

Each API key has predefined TPS (Transactions Per Second) and daily quota limits. Abuse, circumvention, or excessive requests are prohibited.

Prohibited Activities:

You must not use Ascend Tech Solutions APIs for:

Money laundering, terrorist financing, or any illegal purpose

Unauthorized scraping, flooding, or probing of systems

Redirecting funds to unapproved or unrelated accounts

Security Obligations:

Merchants must keep API keys secure and confidential.

Any suspected or actual breach must be reported immediately to Ascend Tech Solutions.

Suspension or Termination:

Ascend Tech Solutions reserves the right to throttle, suspend, or revoke API access at any time for policy violations or misuse, without prior notice.

Audit Rights:

Ascend Tech Solutions reserves the right to audit API usage logs and activity to ensure compliance and system security.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan.

Any disputes shall be subject to the exclusive jurisdiction of the courts located in Lahore, Pakistan.

11. Amendments

We may amend these Terms from time to time.

Users will be notified of material changes via platform notice or email. Continued use of the services after such updates constitutes acceptance of the revised Terms.
